BOOKING YOUR TRIP WITH US

With submission of your booking form and payment of your trip deposit, you agree that you have read and accepted all Terms and Conditions of this agreement as a binding contract between NTS and you, the trip participant(s) A deposit is required to establish and hold a reservation. Full payment is required 60 days prior to the trip start date

 

CONTRACT

The contract ( booking & reservation ) will become effective as from the date the invoice is completed and the deposit is received by Africa Tours & Safaris CC ( hereinafter known as the Company).

The contract is subject to the Namibian Law.

Any person making a reservation accepts the terms and conditions of this agreement set out hereunder.

 

HOW TO BOOK

A 20% deposit of the full amount due is required to confirm any booking and is to be done by the agent or client in writing, by fax or e-mail.

NTS must receive the balance no later than 60 days prior to departure.

If NTS does not receive the total due in 60 days before the departure date, the Company may cancel the reservation and retain whatever deposit or other funds it has already received from the client or his agent.

 

 

HOW TO PAY 

The payment options will be provided by TPI team upon confirmation of a booking.

 

CANCELLATION POLICY

Any cancellation request on a confirmed booking must be done in writing (email) to booking agents TPI & the Company (NTS ) whereupon cancellation charges will apply.

If the booking is cancelled, the following fees apply relative to the amount of notice given:

  • 30 + days:                    Deposit forfeited

  • 15-30 days:                  50% of invoiced amount refunded

  • 14 or less days:           No refund

Please note: the notice period is calculated from the date of cancellation to the start date of the tour/safari booking

No exceptions to this cancellation policy will be made for any reason. We strongly recommend customers obtain trip cancellation insurance from an insurance company

No refund will be made by the Company (NTS )  if, for any reason, inclusions or parts of the tour cannot be carried out / or utilized. These would include all facets such as meals, game drives, accommodation etc. This would also apply to any client who has booked a tour but fails to undertake the tour for any reason.

 

CHANGES POLICY

If a booking is changed to an earlier date than originally reserved, the Company will endeavour to change it. If the booking is for a later date, charges could apply

 

VEHICLE RENTAL

Vehicles  are provided by NTS and the cost is included in the trip cost. Unexpected and uncontrollable situations may require last minute substitution of a vehicle, including after the trip has begun. This includes, but is not limited to, mechanical failure, collision damage and theft. In this instance, NTS reserves the right to substitute the type of vehicle confirmed. Vehicle rental company ( NTS ) will require a mandatory damage deposit also known as excess insurance. NTS will supply the client with an authorization form in advance of the tour with authorization to pay the deposit in the event of damage.

The term “damages” is to exclude reasonable wear and tear. Minor blemishes or paint chips caused from gravel, stones, and insects are considered normal wear and tear, for example. Damage or scratches caused by an accident, driving through bushes or off roadways is not considered normal  wear and tear.

If a driver operates a vehicle after drinking an alcoholic beverage or using a mind-altering drug, the damage waiver signed by the driver  is considered null and void and the driver ( also known as the  client )  incurs unlimited liability for damage to the vehicle and anyone else involved

NTS is not obligated to replace a vehicle damaged by the participant or damaged in a traffic accident.

Customers must be over 25 years of age and be in possession of a valid driver license

Pricing is based on double occupancy: 50% of a room’s cost is built into the base price of the tour for each driver. Single clients who requests a single room (or clients  for whom are unable to arrange a roommate) are required to pay the single room supplement, which covers the 50% of the cost of a room which is not shared by a roommate.

 

 

NON-OBSERVANCE OF TRAFFIC LAWS AND UNSAFE GROUP TRAVEL BEHAVIOUR

If the client/driver does not comply with local traffic laws, or does not practice safe group travel practices as described by the tour leaders and by guidelines provided by NTS, the agreement with the client may be canceled and driving privileges will be suspended. Driving privileges will be suspended for anyone under the influence of drugs or alcohol. Participants agree to refrain from alcoholic beverages until the vehicle have been safely parked for the night.

 

PASSPORT, VISA, DRIVING AND HEALTH REGULATIONS

Participants are responsible for complying with above regulations and all consequences resulting from non-compliance.

 

RESPONSIBILITY FOR CUSTOMER SAFETY

NTS , TPI or the Overland adventures team assisting during tour are not responsible for any accidents. It is agreed and understood that neither NTS, or the TPI agents who are assisting with the tour are the guardians of any customer’s safety and that they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the tour, which might result in injury, death, or other damage to the customer, his property, or his family, heirs or assigns.

 

WEATHER

We cannot be made liable for unpleasant or unsuitable weather conditions that occur during a trip and no refunds or adjustments to the trip price will be made for such conditions.

 

CHANGES TO SCHEDULE: 

On a rare occurrence It may be necessary in some instances to change the schedule that was originally published for a trip, requiring a change in accommodations and routing. Such changes may result from changes in the weather, road construction, or other unforeseen situations.

 

INSURANCE

We recommend that customers take out adequate travel, health and accident insurance as well as trip cancellation insurance. NTS encourages customers to secure medical evacuation insurance.

 

PRICE CHANGES

The Company ( NTS ) reserves the right to increase the price of any tour prior to departure due to factors beyond the control of the Company, such as, without being limited to, and increase in fuel prices, new Government legislation, accommodation price increases, fluctuations in exchange rates, etc.

If the Company announces an in increase in the tour price in terms of this Clause, such addition amount must be paid to the Company before the departure of such tour or else the Company shall have the right to cancel the tour and the charges will apply.

 

CHANGES TO ITINERARY

The Company(NTS) shall at any time have the right, in its entire discretion, to alter the terms of the booking in relation to the route, timetable, itinerary and accommodation. The Company shall, however, make every effort to offer the client an alternative tour of a comparable standard.

Should the alternative be of a lesser standard, the client will be refunded the difference, but should there be an increase, the client shall have the right to either reject the alternative and obtain a refund of the relevant portion of the original contract sum, or to accept the alternative and pay the increased cost. In the event of the client rejecting the alternative tour and claiming a refund, such rejection will be treated as a cancellation and the refund will be calculated according to hereof. The client shall have no claim against the Company for any damages arising out of the alternative booking.

 

RESPONSIBILITY AND LIABILITY

Neither the Company nor any person acting for through and on behalf of the Company shall be liable for any loss or damage whatsoever arising from any cause whatsoever and without restricting the generality of the foregoing shall particularly not be responsible for the loss or damage arising from any errors or omissions contained in its brochure or other literature, late or non-confirmation or acceptance or bookings, loss or damage caused by delays, sickness, injury or death, whether occasioned by negligence or not.

The Company shall have the right at any time at is sole discretion, to cancel or the remainder thereof or to make an alteration in the route, accommodation price or other details. This would include any event of any tour being rendered impossible, illegal or inadvisable by weather, avalanches, strike, war, government or other interference or due to any other cause whatsoever. The extra expenses incurred as a result thereof shall be the responsibility of the client.

The Company may at its discretion and without liability or cost to itself at any time cancel, or terminate, a client's booking and in particular, without limiting the generality of the foregoing, it shall be entitled to do so in the event of illness or the illegal or incompatible behavior of any client undertaking the tour, who shall in such circumstances not be entitled to any refund.

Any person making a reservation with the Company warrants that her or she has the necessary authority to enter into this contract on behalf of the person or persons included in such a booking. The person making the reservation shall be liable for the total amount due to the Company.

 

CLIENTS OBLIGATIONS

It is the onus and responsibility of the client to obtain the necessary comprehensive insurance before departure for any possible cancellations, medical expenses, protection or personal property and money.

The onus is upon the client to ensure that passports and visas are valid for the duration of the safari. The Company cannot be held liable for any necessary visas or other travel documents not held by clients. In the event of a client not having the necessary documentation to enter any area or country the Company shall reserve the right to leave the client a the point of entry of such area or country. In such an event, the Company will not be held responsible to the client for further travel arrangements.

 

HEALTH AND PERSONAL SAFETY

The client shall be reasonably fit to undertake the tour.

Anti-malaria precautions should be commenced prior to tour departure. A medical doctor should be consulted for advice.

Tours offered by the Company cover a wide spectrum of the African wilds and neither the Company, its employees or agents can be held responsible for any injury or other related incidents whilst on the tour / safari.

 

BAGGAGE

Due to the rugged terrain, the Company cannot be held responsible for damage or loss of any personal items including bags, contents of bags or photographic and related equipment. Due to extremely dusty conditions, please ensure all bags are dust proof.

 

ACCEPTANCE OF TRIP TERMS AND CONDITIONS

 

I have read and accept the Terms and Conditions of NTS. I’m aware that driving can be dangerous. I’m aware that traffic conditions, roads, weather and other conditions as well as the actions of other members of the trip can influence the risks. I agree to accept those risks.

I’m an experienced & responsible driver with a valid driver license. As a passenger I’m aware of the potential dangers of driving

I further agree and understand that the owners, operators and agents of NTS or the assisting agents of the tour, are not the guardians of my safety. They, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or my participation in the trip which might result in injury, death or other damage to me, my property, or my family, heirs, or assigns.
